Man tracked down by police for child porn is sentenced to prison

A Tooele man tracked down by police after a warrant was issued for his arrest from Kane County last fall has been sentenced to prison for possessing child pornography.

William Gerald Smith, 49, was sentenced Tuesday in 3rd District Court to up to five years in prison for possessing the illegal material.

The Tooele City Police Department was contacted by a deputy from the Kane County Sheriff’s Office in November 2011 about a $50,000 warrant for the arrest of Smith for suspicion of sexual exploitation of a minor. Smith had recently relocated to Tooele after his employment in Bullfrog, Utah, was terminated.

The warrant had been filed after representatives from Smith’s ex-landlord in Bullfrog went into Smith’s recently vacated apartment in November 2011 to make sure the heat was on so pipes wouldn’t freeze. Unexpectedly, the representatives found several pornographic images of children on the walls of a back room and contacted police.

Tooele police tracked Smith down to a local eatery in January 2012, and then followed him to his residence, where he was taken to the Tooele City Police Department and informed of his right to remain silent. Officers asked if there was currently child pornography on his computer at home, which Smith confirmed and said he had viewed the night before.

A warrant for his residence was obtained, and his computer and information storage devices were analyzed by the Intermountain West Regional Computer Forensics Laboratory in Salt Lake City.

In May 2012, a technician from the lab contacted Tooele detectives and said the analysis was only about 30 percent of the way through the more than a million images and 57,000 multimedia files, and was told that finishing the analysis would not be necessary.

The next month, a report on the analysis stated 30 possible child pornography images and 19 possible child pornography videos had been found. They depicted children and teenagers of both genders in various states of undress, many showing sexual acts.

Smith was charged with eight counts of sexual exploitation of a minor, a second-degree felony, in October 2012, and pleaded guilty to third-degree felony versions of four of those counts in March. The other four counts were dismissed. Smith was sentenced to up to five years in prison for each of those counts, with all terms running concurrent to each other.

In addition, Smith pleaded guilty in September 2012 to one count of attempted sexual exploitation, a third-degree felony, in Kane County. Sentencing for that case was originally scheduled for November 2012 but has been postponed until local charges had been resolved.
